Called the insurance today and I do have legal cover.

Dashcam footage seems to be admissible and they were rather more on my side after seeing it. Not bad really bought it on Friday needed it on Sunday. Quite pleased that is bought a new one with higher res etc.

All happened in Switzerland.

My understanding is that because the guy was injured the police cannot deal with it and they send it to a judge who makes a decision. It will either be one or both of us is fined. I then have some time to appeal that decision.

I think the judge should make that decision this week and then I may have to go in and leave a deposit whilst I await the appeal paperwork.

I think that's how it works.

I'll see what decision is made.

I reviewed the footage again and sent a couple of stills to the police one to show that ha she been going slower he could have stopped in a pull in area and another to show that before he hit me he had lost control and was aiming towards me (see the angle of his wheel).

I've no idea what the decision will be but I really don't think I could have done anything more to avoid the accident. I feel even if I had been completely stationary he would still have hit me.

What a royal PIA for you Stu :o can't offer any useful advice on that one.
On the French camera thing..... you shouldn't get done as they can only fine Brits if they stop you on the spot. I got flashed on the way to Les Comes last year, chatting and forgot the speed limit had dropped for road works, still no ticket :thumbright:

Well I got a call from the police about a fine of €450 so I went in the police station to pay it. I then found out this was a deposit (a bit like bail) because the case has yet to be heard. So I pay the deposit and then if I refuse to pay a bigger fine etc at least they have my deposit. So ok, what the heck, this is their system I'll have to play along. I get my card out to pay it and the police officer says that they only have one machine and it's not in their office. He asks me to get cash out with it but I explain I will be charged lots of money for this and their form so specifically states I can pay on card. We too and fro and I offer to pay over the phone or online but they can't offer me that. So after a minute of debate he crosses out the €450 and writes 0! He said it's their fault they have no machine. I can expect a bill in the post for the deposit but I'm now home and have legal cover on my insurance so they can deal with that.

I find it incredible that a system exists that fines you for something that you had no control over - based on the above comments.

As I mentioned to Stu direct; don't get hung up on trying to equate Justice with Law.
In these financially driven times there is little to no correlation between the two; If the rules say Johnny foreigner is automatically at fault, then that's who gets billed, irrespective of any facts.

Indeed - if nothing else, I'd say you've left the situation in the strongest position possible, with some solid evidence to fight your corner (or for your insurance to), and zero deposit means your not out of pocket while you wait.

PITA as you say, but imagine you'd had the cash and no footage to help your claim?
