Some terms and conditions are called "unfair terms" and are cancelled by consumer rights and especially distance selling.

Also they have 30 days to deliver otherwise they have to ask for a extension anyway.

Their T's & C's can't overrule the law.

Has your friend received both items now? Another option would be to refuse delivery.

I've just checked and distance selling states that you have a right to cancel the order within 7 days of delivery (not order be delivery) therefore your friend should put it in writing that he is rejecting the goods under the distance selling law within the sales of goods act

Distance selling states that you have a 7 day cooling off period upon delivery except for the following:
There are obvious exceptions and you will not have the right to cancel with the purchase of the following goods:

Goods made to a personalised specification (This shouldn't apply to your friend as it is a standard item)
Perishable goods, such as foodstuffs and flowers
Audio/video recordings or software where the seal has been broken
Newspapers, magazines or other reading material (not books)
Gaming, betting, lotteries


Distance selling provides your friend with the following rights:

Additional rights
Customers who buy goods online, by telephone or by mail
order have important additional rights. Customers can cancel
their order

• any time from the moment they place it, up to seven working
days from the day after they receive the goods – even if the
goods are not faulty

• any time from the moment they place it, up to seven working
days from the day after they agree the contract with you for
services bought online

• and claim a full refund if the goods or services that they
ordered are not delivered or provided within 30 days

So basically as long as your within 7 days of receiving the goods or 30 days have gone since the order was placed and nothing received then you're sorted. Sorry I mean your friend is sorted. Are you sure this is for a friend? I didn't think you had any? BCC doesn't count, he's a colleague!

Always, always use a CREDIT card when buying online, over the phone, by mail order etc etc. Never use a debit card.

With a credit card it is generally the credit card company's problem, not yours. That's the deal for them charging 240% a month interest! You just phone them and explain you want to cancel, they retrieve the money back from the company, job done.

Unfortunately, I don't believe the same is true in business, so my poor client who placed a "Special (non-cancellable) Order" for an iMac from a certain well known maker of iThings back in October on a 6 week lead time which was then revised to Mid December and then End December and then Mid January and then End January and now "Maybe 6 more weeks. Maybe 8. We're not sure." is pretty stuffed (and angry).

Amazingly (I kinda think stupidly) he's gone a bought a MacBook Pro on next-day delivery to cover the shortfall in the meantime.

But when I asked if I could cancel the order I was told not. You see, when the order was placed it was notified as a Non Cancellable Order. Being B2B I'm not sure there is much we can do...but there must be a reasonable time frame? I mean, if it takes them 2 years to deliver then the box is going to be a worthless, out-of-date, unfashionable paperweight!

Interesting style of business, though - take the money, deliver nothing!

If it were me I'd tell them to stick it and refund my money sharpish or the debt collectors will be turning up at one of their fancy shops very shortly to start seizing stuff in front of customers, with a full media posse in tow, and plus a guest spot on Watchdog. There is no shortage of anti- :censored: people and right now they don't need any more suggestions that they can't sell or make stuff anymore :lol: Or just stand outside the Regent Street store shouting "where's my iThingy!"

Probably over-egging to say they are going out of business but an ill wind blows........
